PATENTS - Electronic Filing Was
Hard, But is now easier, and sometimes mandatory.T
The USPTO has finally
eliminated the horrible SML authoring program PASAT (which we called "pass out" and hated
with a passion, and we were far from alone, and which we opined was doomed)
from the start due to a fundamentally improper design approach (creating a
tagged document and then trying to shoehorn document sections and images
into the proper location within the tags, rather than the much simpler
approach of taking an existing document in Word or pdf and simply tagging the
appropriate sections.) The PTO has made our prediction come true and
dropped passout in favor of a very slick filing procedure using pdf
files. NaNahNaNahNah, We told them so. Now you should be using EFS
with pdf files. Again, as with TM, there is a cost saving if
you file electronically, and for the nifty new accelerated one-year
examination, you MUST file electronicall |
TRADEMARKS - Electronic Filing Works
Wonderfully
The
trademark electronic application
system ("TEAS") is easy to use,
give significant cost savings (30%), is more secure, is faster, is
more flexible, and is rapidly becoming mandatory, particularly for
trademark attorneys.
It is and easy to use, menu-based questionnaire that asks all the
information that needs to go into a trademark application and then
has an easy upload option for .jpg or .pdf files. It has
built-in error checking, gives you an immediate confirmation of
filing followed by an email to further confirm. It has a
remote signing feature that allows you to send the document to the
actual applicant for signature and return to the USPTO TEAS server,
which then emails you that the application is ready to finalize.
This great system is available 24/7/365. If you are not using it, you should be.
Otherwise, you would be limiting your options, and probably
committing malpractice.

COPYRIGHTS - In Beta Testing.
Good reports so far. The
Copyright Office has an electronic filing procedure under Beta test.
We do not know how copyright filing will work, but sign copyright is
a registration process similar to that for trademarks, we suggest
that it be most like TEAS (Trademark filing program) and then
would work excellently. |

We recommend GetPatPro as
the best sophisticated approach. It is an Italian program with a
simple interface that uses the EPO databases and both does searches and
obtains free copies of the references located, from most major patent
examination countries. |
For US only searches and
copies, we recommend and use Patent Hunter
which has a wonderful interface for rapid searching and bulk entry
of patent numbers and pdf and html format patent copies. It
has become increasingly more expensive, currently $99/yr., but for
someone such as a patent agent or patent attorney that does his own
searching and his own patent ordering, this is a good cost effective
solution. |
Delphion is tstill
the most sophisticated patent search engine on the market, at over
$200/month for an individual. It is also one of the most
expensive. Delphion was originally the IBM patent database and was
more extensive than the US PTO's, but with the PatFT database having
images of all US Patents back to 1790, Delphion now primarily is a patent
information management tool, with sophisticated tools to rank,
interpret |
